1. Agreement to Terms

By downloading, installing, accessing, or using the Town Fair Artworks mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and TOWN FAIR AIRBRUSH, LLC ("we," "our," or "us"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

The Town Fair Artworks App provides information about our airbrush art services, including custom apparel, murals, and other artistic services. The App allows users to:

• Browse our portfolio of artwork and services
• Learn about our services and processes
• Contact us for inquiries and service requests
• View our studio location and business information

3. User Accounts

Some features of the App may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information when creating an account
• Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

5. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of TOWN FAIR AIRBRUSH, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without prior written consent from us, except as follows:

• You may temporarily store copies of materials for personal, non-commercial use
• You may share links to our App on social media platforms
• You may print or download one copy of a reasonable number of pages for your personal, non-commercial use

6. Service Requests and Orders

When you submit a service request or inquiry through the App, you agree to provide accurate and complete information. All service requests are subject to our acceptance and availability. We reserve the right to:

• Accept or decline any service request at our sole discretion
• Modify or cancel services if necessary
• Request additional information before processing a request
• Set prices and terms for services

7. Payment Terms

If you place an order through the App, you agree to pay all charges associated with your order. Payment terms, including pricing, payment methods, and refund policies, will be communicated to you separately at the time of order placement.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWN FAIR AIRBRUSH, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify, defend, and hold harmless TOWN FAIR AIRBRUSH, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, violation of these Terms, or infringement of any rights of another party.

11. Third-Party Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of such third-party services.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state and federal courts located in Escambia County, Florida.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be replaced with a valid provision that comes closest to the intent of the invalid provision.
